Purpose   

Creative Australia is a statutory authority established under the Creative Australia Act 2023 (Cth) 

We support vibrant storytelling, and the sharing of ideas through our social media channels. We encourage respectful public engagement and aim to create a safe, inclusive, and creative space for everyone.  

The purpose of this Social Media Terms of Use Policy (‘Policy’) is to clearly outline the expectations, rules, and responsibilities for anyone engaging with Creative Australia’s official social media channels.  

Policy statement   

Creating a consistent process for managing social media engagement will protect both Creative Australia and the public by creating a transparent, respectful, and safe online environment. 

Scope  

This Policy applies to anyone who interacts with Creative Australia’s official social media channels including, members of the public. It also applies to all “officials”1 of Creative Australia including, but not limited to, employees, independent contractors, Board and Council members, peers and agents and third-party suppliers and contractors who provide services to Creative Australia.  

By interacting with our pages, you agree to comply with this Policy and the relevant platform’s own terms of service.  

Our Channels  

This Policy applies to all Creative Australia social media channels (‘Channels’), including but not limited to:  

  • Facebook  
  • Instagram  
  • LinkedIn  
  • YouTube  

Community Standards  

When interacting with our Channels you agree to engage with others respectfully and constructively. To maintain a safe and inclusive environment, we reserve the right to remove, hide, or report any content or comments that:  

  • Are abusive, defamatory, threatening, discriminatory, or offensive  
  • Contain personal attacks or insults  
  • Use obscene or profane language  
  • Spread misinformation or false claims  
  • Infringe on copyright, trademarks, or intellectual property (including, Indigenous Cultural and Intellectual Property or ‘ICIP’) 
  • Include spam, advertisements, or solicitations  
  • Invade the privacy of individuals (including posting private information without consent)  
  • Incite violence or other illegal activity  
  • Impersonate another person or misrepresent your relationship to Creative Australia 

Moderation  

Our accounts are moderated during AEST (or, AEDT) standard business hours. While we may not respond to every comment or message, we monitor interactions and will take action where necessary.  

Creative Australia reserves the right to:  

  • Remove content that breaches this Policy  
  • Block or ban users who repeatedly breach this Policy  
  • Report serious breaches to respective platform Channel administrators and/or authorities  

Content and Copyright  

You must ensure any content you post to our Channels is your own, or that you have permission to share it. By posting on our Channels, you grant Creative Australia a non-exclusive, royalty-free licence to use, reproduce, and moderate that content in accordance with our goals and responsibilities.  

We respect intellectual property and expect users to do the same. If you believe content posted on our Channels infringes your rights, please contact us directly.  

Privacy  

Creative Australia handles all personal information in accordance with our Privacy Policy. We recommend that, wherever possible, you avoid posting personal information on public platforms including on our Channels.  

By interacting with our Channels, you also agree to the collection and use of your data as governed by the privacy policies of each respective platform (e.g. Facebook, Instagram).

The views expressed by users on our Channels are their own and do not necessarily reflect the views of Creative Australia. We are not responsible for the accuracy, reliability, or legality of any user-generated content.  

We may share or repost content that aligns with our goals and responsibilities, but this does not constitute endorsement.  

Updates to this Policy  

Creative Australia may update this Policy from time to time. Any changes will be published on this page. Continued use of our social media Channels constitutes acceptance of the most recent version.

Definitions  

User/Users 

Any individual, group, organisation, or entity who accesses, views, follows, comments on, or interacts with Creative Australia’s social media Channels. 

Content 

Includes all material posted to Creative Australia’s social media Channels by either the organisation or users. This may include text, images, videos, links, comments, replies, direct messages, or any other form of communication. 

Moderation 

The process by which Creative Australia monitors, reviews, hides, removes, or reports content that breaches this Policy, platform rules, or relevant legislation. 

Inappropriate Content 

Any content that breaches this Policy, including but not limited to material that is offensive, abusive, defamatory, threatening, misleading, discriminatory, or unlawful. 

Platform Terms of Service 

The separate terms, rules, and community guidelines established by each individual social media Channel (e.g. Facebook’s Community Standards etc.), which also apply to any user interactions. 

Personal Information 

Is as defined by the Privacy Act 1988 (Cth) and means information or an opinion about an identified individual, or an individual who is reasonably identifiable: 

  • whether the information or opinion is true or not; and  
  • whether the information or opinion is recorded in a material form or not.
